Chapter 1 General

Article 1 In order to strengthen the management of fresh milk, ensure the quality of fresh milk, protect the health of consumers, and promote the production of fresh milk in the autonomous region and the development of the dairy industry, these regulations are formulated in accordance with the relevant national laws and regulations and the actual conditions of the autonomous region.

Article 2 Units and individuals engaged in the production, purchase, operation and processing of fresh milk within the autonomous region must abide by these regulations.

Article 3 Fresh milk in these regulations refers to unprocessed milk.

Article 4 The autonomous region encourages the development of dairy farming. Governments at all levels should give preferential treatment in terms of capital investment, pasture use, and feed supply to support the development of dairy farming.

Dairy cattle breeding units and individuals should improve the production and quality of fresh milk by improving breeds and feeding methods.

Article 5 Dairy production enterprises shall establish stable cooperative relations with fresh milk production units and individuals, and sign the contract to clarify the rights and obligations of both parties. It can also be combined on a voluntary basis.

Article 6 These regulations shall be organized and implemented by the dairy product management department and animal husbandry management department at all levels.

Chapter 2 Quality Management

Article 7 All League cities may formulate local standards for the purchase of fresh milk in accordance with the national standards for the purchase of fresh milk and the actual situation in the region, and report to the standardization administration of the autonomous region for approval after implementation.

Article 8 The quality indicators of fresh milk, such as sensory, physical, chemical, and sanitation, must comply with the National "Fresh Milk Purchase Standards" and local standards.

Article 9 Fresh milk shall not be mixed with water and other substances.

Article 10 It is forbidden to sell or purchase the following abnormal fresh milk:

(1) Those suffering from mastitis;

(2) Within 15 days before calving and within 7 days after calving;

(3) During treatment with antibacterial drugs and within five days after withdrawal;

(4) Suffering from legal infectious diseases such as brucellosis;

(5) The color changes and smells.

Chapter III Purchase and Sales Management

Article 11 The League Administrative Office and the Municipal People's Government shall reasonably delineate or adjust the scope of milk purchases by enterprises in accordance with the scale and benefits of dairy industry enterprises.

Within the defined scope of milk purchase, dairy companies must protect the interests of fresh milk producers, purchase in time, and cash in milk in accordance with the contract.

Article 12 The price of fresh milk shall be set by the price department of the League City together with the local dairy industry industry management department in accordance with the local fresh milk purchase standards and the principle of high quality and high price.

Article 13 The milk purchasing unit shall purchase milk at the purchase price of fresh milk in the region, and shall not be allowed to raise prices at any pressure or price, or purchase milk beyond the scope of milk purchase.

Chapter IV Quality Supervision and Inspection

Article 14 The milk purchasing unit must be equipped with fresh milk quality inspectors. The fresh milk quality inspectors are trained by the technical supervision department of Meng City and issued with fresh milk quality inspection certificates after passing the examination. Fresh milk quality inspectors hold certificates to check. Fresh milk quality inspectors accept the guidance of the local technical supervision department.

Article 15 Duties of fresh milk quality inspector:

(1) Check the quality of fresh milk in accordance with relevant standards and quality inspection procedures;

(2) It is recommended that the milk purchaser refuse to purchase the fake milk that is adulterated in the fresh milk;

(3) Fresh milk mixed with toxic and harmful substances shall be detained on the spot and submitted to the technical supervision department for processing;

(4) Assist the technical supervision department to supervise the quality of fresh milk.

Article 16 Qi County Technical Supervision Department and Food Sanitation Supervision Department shall conduct quality and sanitation supervision and inspection on fresh milk according to law. The dispute over the quality of fresh milk between the acquiring unit and the producer shall be decided by the technical supervision department.

Chapter V Penalties

Article 17 Anyone who purchases milk beyond the scope of milk purchase shall be ordered by the county-level industrial and commercial administration to stop the purchase and shall be fined a value below the total amount of milk collected.

Article 18 Anyone who unauthorizedly presses the price or raises the price to purchase milk shall be fined by the price department to the person directly responsible for less than two hundred yuan, and the unit is recommended to give administrative sanctions.

Article 19 Any one of the following acts that violates these regulations shall be subject to administrative punishment by the technical supervision department at the county level; if the circumstances seriously constitute a crime, the judicial organ shall be held criminally responsible:

(1) If non-toxic and harmful substances are mixed into fresh milk, a fine of 10 to 30 times the value of the same amount of fresh milk as adulterated milk shall be imposed;

(2) If toxic and harmful substances are mixed into the fresh milk, it shall be confiscated and a fine of not more than one hundred times the value of the same amount of fresh milk as the adulterated milk;

(3) Those who sell the fresh milk specified in Article 10 of these Regulations shall confiscate the products and impose a fine of not more than 500 yuan for those directly responsible.

Article 20 Anyone who makes unreasonable disturbances, assaults on administrative law enforcement personnel, milk purchasers, or fresh milk quality inspectors, or damages the inspection dipstick and milk collection facilities shall be punished by the public security department in accordance with the “Regulations of the People ’s Republic of China on the Management of Public Security Management; , Investigate criminal responsibility according to law.

Article 21 Where administrative law enforcement personnel, milk purchasers, and fresh milk quality inspectors make trouble for dairy households, favoritism, bribery and bribery, or abuse of power, their units shall be given administrative sanctions depending on the seriousness of the circumstances; if they constitute a crime, the judicial organ Be held criminally responsible.

Article 22 If the dairy industry enterprise refuses to purchase fresh milk for no reason or fails to purchase fresh milk on time within the specified scope of milk purchase, it shall be compensated.

Chapter VI Supplementary Provisions

Article 23 The supply of fresh milk for urban residents and other food processing shall be implemented in accordance with these regulations.

Article 24 The specific issues in the implementation of these regulations shall be interpreted by the Autonomous Region Department of Light Industry.

Article 25 These regulations shall take effect as of the date of promulgation.
